Sept. 30: Nearly five months after Udipta Sarma’s shocking death, police have finally filed the chargesheet in the case.
Fifteen-year-old Udipta, a student of Maharishi Vidya Mandir, had died in a scuffle with his classmate, Madhurjya Bora, inside the classroom, following an altercation between the two over a tiffin box during the lunch break. The incident had taken place on May 5.
A case was registered in this connection in the Chandmari police station based on the complaint lodged by Udipta’s father, Pradip Sarma. In his complaint, he said negligence on the part of school authorities was responsible for the death of his son.
The names Madhurjya Bora and a Hindi teacher of the school, Asha Sarma, have been mentioned in the chargesheet filed by the investigating officer of the case, before the additional chief judicial magistrate (juvenile), Kamrup, yesterday.
Madhurjya was booked under Section 304 of the IPC on charges of culpable homicide not amounting to murder. “He was not booked under Section 302 for intentional murder, as during the investigation it was revealed that Madhurjya’s action, which was responsible for the tragic death of Udipta, was unintentional and did not have any motive,” said a police officer associated with the case.
Asha Sarma was booked under Section 304 (A) of the IPC on charges of causing death by negligence. On May 5, Sarma had taken the Hindi class in the fifth period that preceded the lunch break during which the incident had taken place.
Though on May 6, police had arrested the principal of the school, M. Goswami and vice- principal Sujata Goswami, they were not named in the chargesheet.
Madhurjya said during the lunch recess, he along with Udipta, Mukut, Snehasish and Abhigyan had eaten the tiffin of their classmate, Mohammad Zaman, without telling him.
“Zaman immediately complained to his Hindi teacher. When the Hindi teacher questioned Madhurjya, he named Udipta as the culprit. Soon after the teacher left, Udipta charged Madhurjya. And a scuffle broke out between them,” said a police official, quoting Madhurjya’s statement.
