Cops in court to free Lalu 'friends'

Ranchi police have complained against local resident Sumit Yadav at the court of a judicial magistrate on Wednesday alleging he had filed a false case against two persons, one of them an RJD leader, on December 23 hours before a CBI court convicted RJD chief Lalu Prasad in a fodder scam case and sent him to Birsa Munda Central Jail.

Ranchi: Ranchi police have complained against local resident Sumit Yadav at the court of a judicial magistrate on Wednesday alleging he had filed a false case against two persons, one of them an RJD leader, on December 23 hours before a CBI court convicted RJD chief Lalu Prasad in a fodder scam case and sent him to Birsa Munda Central Jail.

Over the last two days, media reports have suggested that Sumit's FIR against his uncle and RJD leader Madan Yadav and associate Lakshman Yadav was designed to ensure the two were sent to jail around the same time as Lalu so that they could take care of the former Bihar chief minister's personal needs there.

However, the police complaint filed in the court of first class judicial magistrate Avanika Gautam on Wednesday does not mention any of this.

City DSP R.K. Mehta said they have asked Sumit to be tried under sections 182 (misleading public servants with false information) and 211 (instituting criminal proceedings on false grounds) of IPC for lodging a false case.

"Police, during in-depth investigations, found that the allegations levelled by Sumit were completely false and there is no reason to keep Madan and Lakshman in jail now," he told The Telegraph.

Police sources said Madan and Lakshman could also be tried for misguiding the court and police. But they admitted it would be difficult for them to prove that Sumit's motive was to get the two Lalu cohorts inside the jail to help the RJD president with his daily needs like food and medicines.

But what gives credence to some of the media reports that Sumit may well have had that intention when he filed the FIR was that Madan, a resident of Saketnagar at Hinoo, is a close associate of Lalu and is known to have performed similar favours for his leader during his earlier stints in jail.

CBI sources said that Madan is one of the petitioners in Jharkhand High Court on behalf of Lalu in fodder scam cases.

"The two seem to be more loyal than the king. This man (Madan) has a previous record of surrendering in a case in 2013 to coincide with the sentencing of Lalu in case RC 20A/96," said a senior CBI official monitoring fodder scam cases.

Lakshman is also a longtime aide of Lalu and is a resident of Patna.

On December 23, Sumit lodged an FIR against Madan and Lakshman at Lower Bazar police station, claiming they beat him up at Kantatoli Chowk at 8.15am when he asked them to return money they owed him.

He also alleged that the two abused him and took away another Rs 10,000.

Police lodged an FIR under section 323 (voluntarily causing hurt), 504 (intentional insult with intent to provoke breach of peace) and 34 (acts done by several persons in furtherance of common intention) of IPC.

Surprisingly, police immediately sent a copy of the FIR to a court where the two landed up to surrender.

"The involvement of the police cannot be ruled out since extraordinary alacrity was shown in what was a minor case. Normally, a police station takes at least one day to submit an FIR copy to the concerned court. But in this case the FIR was sent to the court immediately, and the accused, along with their lawyer, were ready to surrender," said a civil court lawyer.
