Rera gears up for defaulter survey

The real estate regulatory authority (Rera), Bihar, is all set to hire the agency that will do a survey of real estate projects being executed without being registered with it.

Patna: The real estate regulatory authority (Rera), Bihar, is all set to hire the agency that will do a survey of real estate projects being executed without being registered with it.

The hired agency will also keep a tab on websites using which some real estate players advertise their projects in Bihar even though the same have not been registered with Rera, a must under the provisions of Real Estate (Regulation and Development) Act, 2016.

"Tenders have been floated to hire the services of a professional agency for the survey to identify real estate players executing projects in violation of rules," Rera Bihar member R.B. Sinha told The Telegraph. The tender process will be finalised by July end after which the agency will be given a month's time to mobilise resources. Actual survey work will start from September.

Section 3 of the real estate Act provides that no promoter advertise, market, book, sell or offer for sale any plot, apartment or building in any planning area within a state, without registering the project with Rera. This provision applies to projects where area proposed to be developed exceeds 500sqm or number of apartments exceeds eight.

Since its inception in March, Rera Bihar has found that a number of developers are not forthcoming for registration. The authority decided to get a survey of new and ongoing unregistered projects done by an independent agency to ensure compliance with law.

The survey work will be carried out in phases and in the first phase the hired agency will do the work in Patna, Bhojpur, Muzaffarpur, Bhagalpur, Purnea, Vaishali, Rohtas, Darbhanga, Madhubani, Gaya, Samastipur, Saran, Nalanda, Begusarai and Munger districts. "Once we would have survey reports, action will be initiated against defaulters who are not coming forward to register their projects despite of our best of efforts," Sinha said.

As things stand now, only 60 projects have been registered with Rera Bihar and applications have been received for 422 projects. According to rough estimates, over 1,500 projects are being executed in the state which should be registered with the authority. The actual figure would emerge once the survey is conducted.
