FIR against MIM chief brother

Akbaruddin Owaisi, a senior leader of All India Majlis-e-Ittehadul Muslimeen, has landed in trouble after a case was lodged against him for delivering an inflammatory speech at an election rally in Kishanganj on Monday.

Akbaruddin Owaisi, a senior leader of All India Majlis-e-Ittehadul Muslimeen, has landed in trouble after a case was lodged against him for delivering an inflammatory speech at an election rally in Kishanganj on Monday.

Owaisi, an MLA from Telangana, has been booked under sections 188, 153A, 171C of the Indian Penal Code and Section 125 of the Representation of People's Act-1951. Section 125 is non-bailable and he may be liable for imprisonment up to three years if found guilty.

Kishanganj district magistrate Animesh Kumar Parashar said a complaint was lodged against Akbaruddin with the Kochadhaman police station of the district on the statement of the local block development officer, Mritunjay Kumar. The video of the AIMIM leader has also been procured as evidence.

Owaisi had described Prime Minister Narendra Modi as " shaitan" (devil) and "zalim" (tyrant) over the 2002 Gujarat riots. Referring to the Prime Minister, Akbaruddin said: " Ye Gujarat ke danga karane wale zalim. Ye shaitan mahilayon par ho rahe atyachar ko chup chap dekhte rahe. Gujarat mein logo ko gher gher ka mara gaya, bache aur mahilaon ko zinda jalaya gaya."

"There is a section, including me, who hold none other than Modi responsible for the 2002 Gujarat riots," Owaisi, the younger brother of MIM chief Asaduddin Owaisi, told the gathering at a local primary school.

Kishanganj superintendent of police Rajiv Ranjan said it was being ascertained whether damage to idols at two religious places in the town, which was discovered on Monday morning, was a result of the provocative speech of Owaisi. "Owaisi's speech violated provisions of sections 188, 153A, 171 of the IPC and section 125 of the RP Act," he told The Telegraph over phone. Section 153A deals with promoting enmity between different groups on grounds of religion, race, place of birth, residence, language and act prejudicial to maintain harmony, while Section 188 deals with disobedience to order duly promulgated by public servant.

The station house officer of Kochadhaman, Chandan Prasad Yadav, said the police have the authority to grant bail to the accused from the police station even if Section 153A is non-bailable.

Yadav said Owaisi had addressed an election meeting at Sontha Haat village under the Kochadhaman constituency in Kishanganj on Sunday from where AIMIM state unit chief Akhtarul Imam is contesting.

"Owaisi had allegedly used abusive language against all members of parliament except his elder brother Asauddin Owaisi, who is AIMIM chief and MP from Hyderabad. He also made provocative remarks against some BJP leaders also," the SHO added.

The senior Owaisi on Monday released the list of six candidates from Muslim-dominated constituencies falling under Kishanganj, Purnea, Araria and Katihar districts. The Seemanchal accounted for 24 of the 243 Assembly constituencies.
