Guwahati, Oct. 6: A local court here today sentenced popular singer Zubeen Garg to three months' simple imprisonment for assaulting one of his teenage# fans here in 2013.
The boy is the son of senior advocate Arup Chandra Borbora and grandson of former chief minister Golap Borbora.
The judicial magistrate first class, Sarfraz Nawaz, convicted Zubeen under Sections 323 (voluntarily causing hurt) and 506 (criminal intimidation) of the IPC.
The court, however, found him not guilty under Section 341 (wrongful confinement).
'Zubeen Garg was sentenced to undergo three months' imprisonment each under the two sections and both the sentences will run concurrently. He was also ordered to pay a fine of Rs 5,000,' said assistant public prosecutor Sazzad Zahir.
But the singer will not go to jail immediately as the court released him on bail today to enable him file an appeal in a higher court. As per law, a person sentenced to less than three years' imprisonment is entitled to bail for filing an appeal.
'We will file an appeal against today's order in the district and sessions court,' Zubeen's counsel Junmoni Devi Khound said.
'It was a small incident. I have full faith in the judicial system,' Zubeen said while coming out of the court after his conviction. He asked his fans not to worry.
The incident happened on June 29, 2013, when Zubeen assaulted the 16-year-old fan near Zoo Road Tiniali when he went ahead to shake hands with the singer. A case was registered against Zubeen at Geetanagar police station after the boy's father lodged a complaint against him.
Borbora said Zubeen not only slapped and kicked his son without any provocation but also attempted to abduct him.
According to Zubeen, he had slapped the boy for smoking in front of him.
'Till yesterday he (Zubeen) was an accused but after today's court order he has become a convict. No one is above the law,' Borbora said.
Zubeen is no stranger to controversies. Last month, he had to apologise after an altercation with an army officer when the latter objected to the singer wearing an army beret at New Delhi airport.
In June this year, he had to obtain bail from a local court in a case registered against him at Azara police station in the city in 2016, based on an FIR filed by the Central Industrial Security Force (CISF) accusing him of violating security norms at Lokpriya Gopinath Bordoloi International Airport.
According to the CISF, Zubeen, who was to board a Calcutta-bound flight, had allegedly confronted the CISF personnel on duty when they asked him to remove his shoes for frisking at the airport.
