Patna: Special Pocso judge Ravindra Nath Tripathi on Wednesday convicted Santosh Kumar, a 25-year-old man and a father of four, in a case related to kidnapping, confinement and rape of a 14 year-old girl student from a city school.
The quantum of punishment will be pronounced on April 3.
The court held Santosh guilty under Section 365, 366 (A) and 376 of Indian Penal Code (IPC) along with Section 4 of the Protection of Children from Sexual Offences Act (POCSO Act) 2012.
Section 365 of IPC deals with kidnapping or abduction while Section 366 (A) deals with inducement of minor girl and Section 376 concurs to rape. Section 4 of POCSO Act relates to punishment for penetrative sexual act.
Santosh, a resident of Hazari Mohalla, Noon Ka Chowraha, under Khajekalan police station in Patna City, had kidnapped the girl on December 17, 2016, while she was on her way to school to write an exam.
The girl's mother registered a case at Kotwali police station the same day the incident took place.
Kotwali police filed a chargesheet in the case on February 25, 2017.
After kidnapping the girl from an auto-rickshaw she was riding on, Santosh took her to Nepal and kept her there for six days.
Six days later, he brought her to Patna and confined her at his brother-in-law's house from where the police recovered her on December 23, 2016, special public prosecutor Suresh Chandra Prasad told court.
