
Suri, June 24: Birbhum police, in their final report to the chief judicial magistrate's (CJM) court in Suri today, charged district Trinamul chief Anubrata Mondal under bailable sections in connection with his inflammatory speech in the run-up to the 2013 panchayat polls.
Mondal had exhorted cadres to burn down the houses of dissidents contesting the elections as Independents and bomb the police if they came to the rescue. Three days after the speech, the father of a dissident was shot dead by suspected Trinamul activists. Although Mondal had been named in the FIR, his name did not figure in the chargesheet.
After Mondal's speech on July 17, 2013, the police had started a suo motu case on his comments on the instructions of the state election commission.
In the final report, the police have not charged Mondal under any non-bailable section despite instructions from the Suri court.
Chief judicial magistrate Indranil Chatterjee accepted the report and asked Mondal to appear before the court on July 7.
BJP leaders and a section of advocates alleged that "soft charges" had been brought against Mondal.
The police had charged Mondal under IPC sections 189 (threat or injury to public servant), 505 (i) (b) (intent to cause, or which is likely to cause, fear or alarm to the public) and 506 (criminal intimidation).
On July 26, 2013, the CJM's court had asked the police why Mondal had not been booked under non-bailable sections. The court had directed the police to include IPC sections 436 (mischief by fire or explosive substance with intent to destroy house), 117 (abetting commission of offence by the public), and 353 (assault or criminal force to deter public servant from discharge of his duty).
These sections were then brought against Mondal but were dropped from the final report, which includes only sections 189, 505 (i) (b) and 506.
Mondal today said the "law would take its own course". "I have full respect for the law."
Asked whether he would attend court on July 7, he said: "I will not violate the court order."
The public prosecutor in Birbhum, Ranjit Ganguly, said today: "The court had asked why non-bailable sections had not been included. I had advised the police to investigate the case by tagging the sections suggested by the court. However, they found that no arson attack had taken place on any house following his speech. No public servant was hurt either. So, the police submitted the final report with the same sections with which they had started the case."
BJP leaders said the final report had made it clear that the police had "softened" the case to help Mondal.
"The house of an Independent was burnt down a day after Mondal's speech in Kasba's Gopalnagar village. My father was killed by goons backed by Mondal three days after his speech. But the police unfortunately did not find anything during the investigation," said Hriday Ghosh, whose father Sagar was shot dead. Hriday has switched to the BJP from Trinamul.
