CBI tenders apology for judge house visit

New Delhi: The Supreme Court on Friday quashed an Odisha police FIR against the CBI after it tendered an unconditional apology for allegedly visiting the residence of sitting Orissa High Court judge Chittaranjan Das on September 20 last year.

Appearing for Orissa High Court registry, advocate Sibo Sanker Misra informed the bench headed by Justice A.K. Sikri that Chief Justice of the high court and Justice Das also had no objection to the case being quashed after the CBI tendered an apology.

The quashing of the FIR brought an end to the unsavoury incident.

The CBI had earlier rushed to the top court seeking stay on possible arrest of its personnel, including an SP-rank officer, by Odisha police after the Orissa High Court Bar Association and some lawyers filed a criminal case against the probe agency on charges of trespassing into a judge's premises.

On September 20 last year, the CBI sleuths had arrived at the official residence of Justice Das in connection with a bribery scam related to a UP-based medical college involving retired Orissa High Court judge I.M. Quddusi.

The sleuths had visited the bungalow of Justice C.R. Dash around 2am in search of Quddusi, who had left the house in 2010. However, realising the faux pas, the CBI officials left in a huff but not before landing in a soup.

The goof-up happened as the arrested former judge had stayed at the Gopabandhu Marg in Cuttack during his tenure at the high court from December 6, 2004, to March 25, 2010. Qudussi had retired from Chhattisgarh High Court on June 17, 2012.

The incident provoked protests from the Orissa Bar Association, which subsequently lodged a criminal complaint of trespass, intimidation and other offences against the CBI officers.
