Cuttack, Aug. 19: The one-member judicial inquiry commission of Justice P.K. Mohanty, which is probing into the alleged Pipili gangrape case, has asked the state government to clear the air over medico-legal procedures that are being practised in the state.

Yesterday, the commission fixed September 7 as deadline for the state government to submit the state’s prevailing medico-legal case guidelines.

A medico-legal case is defined as “any case of injury or ailment where, the attending doctor, after history-taking and clinical examination, considers that investigations by law enforcement agencies are warranted to ascertain circumstances and fix responsibility regarding the said injury or ailment according to the law”.

The commission feels the guidelines are necessary to assess the statements filed before it on procedures adopted in treatment of victim vis-à-vis alleged lapses.

The commission’s direction to the state government assumes significance as the Odisha CID-Crime Branch had filed chargesheets against three doctors and two of them were charged with not giving proper attention to a medico-legal case and not intimating the nearest police station.

The alleged gangrape victim was found in an unconscious stage from a paddy field near Arjungoda village under Pipili police station limits on the morning of November 29 last year.

The Justice P.K. Mohanty Commission has been appointed to ascertain the circumstances leading to the loss of consciousness of the Dalit girl and submit a report within three months. The commission has also been asked to identify the persons responsible for the incident and the role of the police in discharging the responsibility.
