Lens on SCB and Capital

Cuttack, May 29: The one-member judicial inquiry commission of Justice (retd) P.K. Mohanty probing into the alleged 2011 Pipili rape will shortly ascertain "...how the patients requiring immediate attention at the casualties of SCB Medical College Hospital and Capital Hospital are received and given treatment".

The victim, Babina Behera, was recovered unconscious from a paddy field near Arjungoda village within the Pipili police limits on the morning of November 29, 2011.

The incident came to light when the Dalit girl was initially denied proper treatment at Capital Hospital and SCB. She was admitted at the special intensive care unit at SCB on January 11, 2012 following intervention of Orissa High Court. She died there on June 21, 2012.

The commission will also ascertain "the manner and mode in which the patients requiring immediate attention are, if necessary, send to appropriate department for treatment and whether the casualties have provision for attending the patients by specialised doctors".

"For the investigation, the commission has formed a seven-member committee. It will shortly make a spot inquiry, according to the point of reference set by the commission. It is expected to submit its report on June 4," commission secretary Niranjan Nayak told The Telegraph.

The commission was appointed on January 13, 2012 to ascertain the circumstances leading to the loss of consciousness of the alleged rape victim. The commission was also asked to identify the persons responsible for the incident and the role of police in discharging their responsibility.

A petition, filed before the commission, had mentioned that the evidence Babina's father Babuli Behera and brother Amulya had disclosed before it stated that the patients, especially the emergency ones, were not attended promptly at the casualties at SCB and Capital Hospital. Consequently, the treatment is not rendered properly causing serious prejudice to the patients.

Some of the witnesses had also complained of inadequate infrastructures, non-availability of specialised doctors and inordinate delay in treatment, as a result of which, the treatment rendered to them are not appropriate.

Taking into consideration the facts and circumstances, the commission had formed the committee for the investigation by invoking the Orissa Commission of Inquiry Rules 1979.

The last sitting of the commission was held on May 25. The next sitting has been fixed for June 4.
