Kunduli probe details sought

Orissa High Court on Tuesday virtually started monitoring the ongoing judicial probe into the alleged Kunduli gang-rape and suicide case by seeking details of the inquiry commission's notices on the incident.

Cuttack: Orissa High Court on Tuesday virtually started monitoring the ongoing judicial probe into the alleged Kunduli gang-rape and suicide case by seeking details of the inquiry commission's notices on the incident.

The inquiry commission was appointed on December 26, 2017, to probe the alleged gang-rape. The court sought the details while adjudicating on two public interest litigations (PILs) seeking CBI probe into the incident.

Former Lok Sabha member Kharavela Swain had filed a petition seeking a CBI probe into the incident raising doubts over the ongoing investigation by crime branch of state police.

Another PIL was filed by the victim's brother, Bhagaban Chhati, which the Supreme Court had transferred to the high court in February for being taken up along with similar pending cases.

The state government submitted counter affidavits to both the petitions. "It was brought to the notice of the court that members of the victim's family were not co-operating with the inquiry commission and were not appearing before it for hearing. Some other parties who were also issued notice were not appearing before the commission," state counsel Janmejaya Katikia said.

"Taking note of it, the division bench of Chief Justice Vineet Saran and Justice B.R. Sarangi posted the matter to July 19 for hearing along with details of the process adopted for issuing notices seeking information and depositions on the incident," Katikia said.

"The bench also directed the crime branch police superintendent and the investigating officer in the case to be present in the court in person on July 19," the state counsel said.
