Fresh high court order on house use

Cuttack, Oct. 25: Orissa High Court has issued fresh orders to stop residential houses from being used for commercial purposes at the Bidanasi project area developed by Cuttack Development Authority (CDA).

“The two-judge bench of Justice B.P. Das and Justice M.M. Das reiterated in their new order to take steps to stop the use of land after finding that the CDA was lagging behind in implementing the earlier court order,” amicus curiae D.N. Lenka told The Telegraph today.

The high court had previously issued the order on July 22 after the CDA filed an affidavit stating they had started proceedings in more than 200 cases in which residential building were being used for commercial purposes.

The court had given one year to business establishments (on condition of filing an undertaking before CDA) to vacate the residential premises.

When the case came up for hearing yesterday, the court found that undertakings were filed in less than 20 cases. In five cases, the business establishments had given the undertaking to vacate the residential premises, on the condition that CDA would provide alternative accommodation.

“Taking note of this, the court rejected the plea, saying the CDA is not bound to provide alternative accommodation to the business establishment, which are at present operating illegally in residential buildings,” Lenka said.
