Dhal Samant trial from June 6

Fifteen months after the arrest of gangster siblings Sushant Dhal Samant, 46, and Sushil Dhal Samant, 43, the two will face trial as prime accused in a kidnapping and murder case dating back more than three years ago.

Cuttack, May 12: Fifteen months after the arrest of gangster siblings Sushant Dhal Samant, 46, and Sushil Dhal Samant, 43, the two will face trial as prime accused in a kidnapping and murder case dating back more than three years ago.

The Dhal Samant brothers were arrested for their alleged involvement in this kidnapping and murder case on January 29 last year.

The case related to alleged kidnapping and murder of their associate Dipu alias Manoj Mallick in November 2013.

The Chaulianganj police station had registered the case and started investigation in January last year after the court of the sub-divisional judicial magistrate (SDJM), Cuttack, directed it in pursuance of a high court order on a petition filed by the victim's father - Adwaita Mallick.

Chargesheet in the case was filed in the court of the SDJM, Cuttack, on May 26 along with recorded statements of 100 witnesses and reports of forensic experts.

The Dhal Samant brothers along with others accused in the case were presented before the SDJM, Cuttack, during hearing on the chargesheet on Wednesday.

"After taking cognisance of the chargesheet, the SDJM, Cuttack, Bijay Kumar Das committed (sent) the case to the court of district and sessions judge, Cuttack, for trial," additional public prosecutor, Biswajit Baral said today. "The charges will be framed by the district and sessions court for commencement of trial. The date for it has been fixed for June 6."

The gangster siblings were charged with murder, abduction, destruction of evidence and criminal conspiracy and Arms Act along with 12 other cases.

The prosecution story in the 1,120 page chargesheet alleged that the victim, Dipu alias Manoj Mallick, was abducted and taken to a farmhouse near Athagarh in Cuttack district, tortured and brutally killed. Later, the body was taken to Singhbhum area in Jharkhand, dumped there and set on fire using petrol. Two vehicles - a Honda City and a Mahindra Scorpio - were used.

After a few villagers spotted the body, local police seized the body but could not identify him as it was 70 per cent burnt. After conducting an autopsy the local police buried the body while registering a case of murder involving several persons and had closed the case later.

During investigation involving forensic experts, evidences found at the farmhouse matched those of the body, the prosecution claims in the chargesheet which includes a DNA report.

Of the 14 accused in the case, four are absconding. The eight others arrested and named accused in the case along with the Dhal Samant brothers are Debashis Kar, Nirmala Rout, Subendu Das, Bolanath Bhagat, Arif Khan, Sanjay Sahoo, Debashis Sahoo and Bharat Behera. The four accused absconders in the case are Chandrakanta Sahu, Sanjay Behera Debadutta Das and Pradeep Sahoo.
