HC guidelines on bail bonds

Guwahati, Dec. 16: Gauhati High Court today laid down certain new guidelines regarding bail bonds.

During the hearing of a bail plea, a division bench of Chief Justice (acting) K. Sreedhar Rao and Justice Chi-tta Ranjan Sarma said in the bail bonds furnished to the court, the bailer will now have to submit his voter ID card or PAN card, thumb impression along with a photograph.

The court also said the lawyer, who identifies the bailer, will also have to give his bar licence number in the bond.

Today’s order will be applicable to all courts under the jurisdiction of the high court and in applications for regular bail under Section 439 CrPC and anticipator or pre-arrest bail pleas made under Section 438 CrPC.

The court order came in the wake of reports that a few gangs are helping criminals get bail through fake bonds.
