
Another accused in the Sapphire International School murder case moved court in Ranchi on Friday, seeking bail for the first time on the ground of no direct proof against him.
Jailed mathematics teacher Arif Ali Ansari, who has been charged with tampering with evidence after his 16-year-old son fatally wounded Class VII student Binay Mahto with knuckledusters, submitted the petition in the court of judicial commissioner Yogeshwar Mani. The court reserved its order till Monday.
Last month, Ansari's 12-year-old daughter and co-accused, who is in judicial custody at Nari Niketan in Namkum since February 11, had made two unsuccessful attempts to secure bail from the Juvenile Justice Board and the court of Mani on the same. Currently, her bail petition is pending before Jharkhand High Court.
Ansari's jailed wife and Sapphire Hindi teacher Nazia Hussain, and their son who is lodged at a remand home in Dumardaga have not moved court for bail so far.
According to defence counsel Chandrashekhar Pandey, who engaged senior lawyer Sambhu Prasad Agrawal for arguments in court, said the bail petition was heard around 10am and June 6 was fixed as the date for the order
"We told the court that there is no direct evidence against Ansari, who was then teaching and living at Taurian World School, 3km from the Sapphire campus in Hardag, where the alleged murder took place. Apart from police case diary and charge sheet, there is nothing more to nail him. There is no substantial evidence," Pandey said.
Advocate Rajesh Kumar, who is representing Binay's father Manbahal Mahto, said he along with assistant public prosecutor Sanjeev Sinha had opposed the bail petition.
"We told the court that Ansari should not be granted bail at the moment since, according to the charge sheet and case dairy filed by police, he guided his family to tamper with evidence of murder. He should not walk out of jail in the interest of the case," Kumar said.
Twelve-year-old Binay was bludgeoned with knuckledusters by his school senior - Ansari and Nazia's son - on February 5 allegedly because he had a crush on the boy's sister.
Nazia and her son then threw Binay off the balcony of the teachers' hostel while her 12-year-old daughter helped mop up the mess. The student was declared brought dead in hospital.
The family was arrested five days later. They have been in judicial custody since.
