Payment misses court due date

Retired Bihar State Sugar Corporation (BSSC) employee Vinod Poddar did not receive any payment on Wednesday from the corporation or Bihar State Human Rights Commission (BSHRC), despite the deadline set by the high court.

The court, in an order last Friday, had set Wednesday as the deadline for BSSC to release Rs 2 lakh to Poddar as compensation against his pending salary.

Lakshmeshawar Jha, the cane commissioner-cum-managing director of BSSC, told The Telegraph on Wednesday: “A cheque of Rs 2 lakh was released this evening by the treasury to the managing director of the corporation. We would issue a cheque in Poddar’s name tomorrow (Thursday) and present it for the hearing of the case.”

Poddar’s counsel, Aditya Narain Singh, claimed that he would appeal for a contempt of court order proceeding against the corporation if the cheque was not received till the hearing, scheduled on Thursday. He said: “BSSC has already violated the high court order by not making the payment today (Wednesday). They are liable for contempt of court order proceeding. If the cheque is not delivered before or during tomorrow’s hearing then I would make a plea for initiating a contempt of court order proceeding against the corporation.”

Singh is fighting Poddar’s case for free. Poddar has not received around Rs 17.5 lakh due as salary from the corporation for six years and post retirement benefits including pension.

The state human rights commission is also supposed to pay Rs 1.5 lakh to Poddar as outstanding imbursement against his deputation at the commission between May 2010 and August 2011. Justice S.N. Jha, the chairperson of the commission, told The Telegraph on Wednesday: “The finalisation of pay fixation to Poddar is yet to be done by the finance department. We would give the money to him as soon as the matter is finalised by the finance department.”
