Patna, Aug. 4: Ashok Kumar Agarwal may land in further trouble.

A complaint has been lodged with the state election commission, demanding dismissal of the BJP MLC from Katihar for allegedly hiding information about his criminal antecedents in the affidavit that he had filed to contest the 2010 elections.

Agarwal is at present lodged in Katihar divisional jail for allegedly shooting one of his employees, Dheeraj Kumar, with the licensed carbine of his bodyguard at his petrol outlet-cum-residence in the Meerchayibari area of Katihar town on July 17.

Uday Prakash Upadhyay, the counsel of the deceased’s brother Neeraj, said a written complaint had been filed with the poll panel yesterday demanding Agarwal’s dismissal because he had allegedly concealed facts about his criminal antecedents.

Upadhyay said though Agarwal was made a named accused in the murder case of Vijay Thakur, a resident of Dadan village in Katihar district on December 4, 2008, he had not mentioned it in his affidavit, which he filed in the court of the sub-divisional magistrate (Katihar) on June 20, 2009 to contest the Assembly election.

Agarwal, however, mentioned another case (No. 145/08) lodged with Katihar police station under sections 147, 148, 149, 342 and 302 of IPC and Section 27 Arms Act.

Upadhyay said: “Concealing facts is a serious offence. The copy of the complaint has also been forwarded to the Election Commission of India for necessary action.” He added that Agarwal had gone into hiding after his name figured in the murder of Thakur.
