The CBI on Tuesday requested the Calcutta High Court that it order cancellation of bail given by the Juvenile Justice Board to two boys accused in the Bogtui arson case in which 10 people were burnt to death, claiming that due process was not followed in granting them the relief.
Appearing for the CBI, Assistant Solicitor General Billadwal Bhattacharyya submitted before a division bench that the central agency, which is investigating the case on an order of the high court, was not given notice for the hearing of the bail prayer before the Juvenile Justice Board.
He urged the bench presided over by Chief Justice Prakash Shrivastava that the bail granted to the two boys be cancelled by it since it is monitoring the progress of the investigation in the case.
Appearing for a petitioner in one of the several PILs in the arson at Bogtui in Birbhum district following the murder of a Trinamool Congress deputy panchayat chief, advocate Phiroze Edulji claimed that the law provides that the public prosecutor has to be given notice in a case if the crime alleged attracts a punishment of life imprisonment.
Seeking cancellation of bail to the two juveniles who are among several accused arrested in the case, Edulji submitted that any such notice was not given.
The bench, also comprising Justice R Bharadwaj, said that it will later pass an order on the prayer, which will be uploaded to the high court's website.
