Bhubaneswar, Oct. 22: Writer and producer Yash Patnaik, who hails from Orissa, has claimed that his concept was used without permission in Bollywood superstar Shah Rukh Khan’s upcoming mega movie Ra.One, which is scheduled for a Diwali release next week.
While hearing Patnaik’s case, Bombay High Court on Friday directed the makers of Ra.One to deposit Rs 1 crore to avoid an injunction on the film.
Patnaik, who has worked with major television production houses such as Fireworks of CID fame and had produced the horror film Kaalo in 2010, said the concept of Shah Rukh’s film and the title ‘One’ were similar to that developed by him for a television series which he had discussed with one of the script writers of Ra.One, Mushtaq Sheikh, much before the film was planned.
“We filed a case earlier this week and sought an injunction on the film. The court ordered the makers of the film to deposit Rs 1 crore to avoid an injunction. But the case will go on and we will continue to fight for our right,” Patnaik told The Telegraph.
“We are not withdrawing the case as of now,” he said.
A division bench comprising Chief Justice Mohit Shah and Justice Roshan Dalvi had asked Shah Rukh’s production house Red Chillies Entertainment and Eros Entertainment to deposit the amount by Saturday.
The judges had observed that prima facie it appeared to be a case of copyright violation.
The court will hear the case in November. Since the deposit has been made, the film will be release on Wednesday.
Patnaik added that he had also asked for credits in the film. “We had asked for credits but now it is too late since the prints have already been distributed,” he said.
Patnaik claimed that he had also sought a 10 per cent of the film’s profits.
