Bhubaneswar: Announcing the amnesty scheme to regularise the construction deviations in urban and semi-urban areas across the state here on Wednesday, housing and urban development minister Niranjan Pujari laid down the norms to get benefits of the programme.
However, he clarified: "The scheme would require that fire safety requirements under the provisions of Odisha Fire Prevention and Safety Rules, 2017 are fully adhere to," he clarified.
Parking deficit fees will be levied for regularisation of unauthorised construction due to deficiency in required parking space. The fee for residential area in any municipal corporation has been fixed at Rs 10,000 per square meter and Rs 17,500 per square meter for non-residential area. In municipal areas the corresponding rate is Rs 8,000 and Rs 15,000, respectively. In areas under Notified Area Council the rates are Rs 6,000 and Rs 13,000, respectively, while for rural areas falling in limits of development authority it is Rs 5,000 and Rs 10,000.
Besides, the compounding fee for regularisation of unauthorised constructions with respect to front, side and rear portion will be 40 per cent extra to the existing fee in case of municipal corporation areas, additional 30 per cent for municipal areas, 20 per cent more for Notified Area Council areas and 10 per cent extra for rural areas.
In case of regularisation of construction undertaken on plot size up to 100sqm with a maximum built-up area of 150sqm, a compounding fee of Rs 20,000 will be charged.
Apart from it, violation in floor area ratio (FAR) will be regularised at the rate linked to the benchmark value of the building.
The scheme is applicable only for constructions on private plots. Unauthorised constructions on government land, roads or drains will not be regularised. The amnesty scheme will also not be allowed in case of constructions undertaken in violation of the Ancient Monuments and Archaeological Sites and Remains Act, or in violation of the height restrictions notified by the Airports Authority of India or in contravention of laws related to coastal regulation zone or eco-sensitive zones, said the minister.
But, he admitted that no survey had been conducted at any place prior to the formulation of the amnesty scheme.
