
The judicial remand of Sapphire International School Hindi teacher Nazia Hussain and her husband Arif Ali Ansari, who are facing charges of tampering with evidence in the murder of Class VII student Binay Mahto, has been extended till May 30.
The couple, lodged in Birsa Munda Central Jail in Hotwar, Ranchi, since February 11, was on Monday produced in the court of judicial magistrate Arwind Kumar who also committed the case for trial in a sessions court.
Prosecutor Rajendra Prasad Gupta said before extending the judicial remand, the court provided police papers to the accused, informing them about the nature of crime they had committed according to the law. Police have filed the charge sheet under Sections 302 (murder), 201 (tampering with evidence) and 34 (common intention) against them.
Asked in which sessions court the trial would take place, Gupta said it would be decided by principal judicial commissioner Navneet Kumar within a couple of days. He added that erstwhile judicial magistrate Chandrabhanu Kumar had been promoted as additional judicial commissioner and hence, all cases under him had been transferred to the court of Arwind Kumar.
The Sapphire case dates back to February 5.
Twelve-year-old Binay was battered with knuckledusters by Nazia's 16-year-old son, a Class XI student of the same Hardag school, for allegedly having a crush on her 12-year-old daughter. The family then threw the boy off the first-floor balcony of the teachers' hostel on campus. Binay was declared brought dead in hospital.
On February 10, police arrested Nazia, Arif and their children, the latter being sent to correctional homes. The juvenile girl knocked the door of a lower court for bail recently. But, on May 7, judicial commissioner Yogeshwar Mani dismissed the plea.
