The Class VI student of Sapphire International School, Hardag, who is facing the charge of tampering with evidence in the Binay Mahto murder case, has moved court for bail.
Judicial commissioner Yogeshwar Mani will hear the 12-year-old's appeal on Ranchi civil court premises on Tuesday, her advocate Chandrashekhar Pandey said on Monday.
Pandey said on April 7 the appeal was transferred for hearing from the court of then principal judicial commissioner A.V. Singh. The minor girl had approached Singh after her bail petition was rejected by the Juvenile Justice Board on March 30.
"The girl, who is currently lodged at a probation home in Namkum, has appealed that she be allowed to stay with her uncle, Shahid Ali, since her parents are in jail," the advocate added.

Ali, who has come from Riwa in Madhya Pradesh, said the family was making concerted efforts to secure bail for his nephew too.
The 16-year-old student of Sapphire is accused of bludgeoning Class VII boy Binay with knuckledusters on February 5 and then throwing him off the teachers' hostel balcony for allegedly having a crush on his sister. Binay was pronounced dead in hospital the same day.
"My nephew is at a remand home in Durdaga while his parents (Sapphire Hindi teacher Nazia Hussain and former mathematics teacher Arif Ali Ansari) are lodged at Birsa Munda Central Jail. It is unfortunate that the family of four, which came to Sapphire International to excel in academics, is in custody for murder. They are victims of a conspiracy hatched by the influential school management. We will seek bail for all soon," Ali said.
In a related development, Nazia and Arif were on Monday produced in the court of judicial commissioner Chandrabhanu Kumar who extended their jail remand in Hotwar till May 16.
Family members of Binay have refused to buy love as the trigger for the 12-year-old's murder. Under the banner of Ranchi Abhibhavak Manch, they have moved Jharkhand High Court for a CBI probe. The next date of hearing for that is Wednesday.
