Bhagalpur, March 10: Delhi Public School (DPS), Bhagalpur has expressed concern over the state government’s lackadaisical attitude for not initiating flood-control measures and constructing a proper sewerage in Bhagalpur town.
Four months have passed after a division bench of the Patna High Court passed a directive in a writ petition filed by the school.
The DPS management has now decided to start proceedings against the respondents in the case, the district administration and the departments concerned for contempt of court order.
Rajesh Kumar Srivastava, the pro-vice-chairman of DPS, Bhagalpur, said earlier, the school manager, Deepak Kumar Sinha, had filed a public interest litigation (PIL) on behalf of the school management at Patna High Court. The state of Bihar, through the chief secretary, the principal secretary, the water resources department, the engineer-in-chief of the water resources department, the engineer-in-chief (central), the water resources department, the principal secretary, rural engineering organisation, the principal secretary, minor irrigation department and the Bhagalpur district magistrate were made respondents in the case.
Srivastava said the recurrent floods posed a threat to the school located on the banks of river Ganga. The PIL sought a sewerage system for early overflow of flood water.
He said the division bench of justices Shiva Kirti Singh and Hemant Kumar Srivastava, in their judgment (CWJC number 1756 of 2010), the copy of which available with The Telegraph, directed the respondents to construct an embankment on the river bank flowing behind the school complex in Babupur Sabour and also to build a proper sewerage for quick overflow of the flood water. The court had also directed the respondents to stop digging sand from the riverbank, a major cause behind the floods in the area.
Srivastava alleged that four months had passed since the judgment was delivered on October, 8 last year but not a single respondent, including the Bhagalpur district magistrate, has not taken notice of the court’s judgment.
“We have prepared the blueprint to solve the problems and sent it to the authorities concerned but no one has yet shown interest in it,” he said. He said the school management has decided to file a case of contempt of court against the respondents. “The school management so far has incurred losses of Rs 1.5 crore because of recurring floods,” he said.
Not a single official concerned, including Bhagalpur DM, was available for comment. A source in the DM’s office said since DM Narmadeshwar Lal has recently taken charge, he was probably unaware of the case. “We don’t have any information about such a case, please contact Patna. They might give you the latest update on the case,” said a water resources department officer, on condition of anonymity.
