Oct. 29: Road rage accused Rocky Yadav, who allegedly shot dead Class XII student Aditya Sachdeva in a burst of anger at being denied right of way in May, today surrendered before the Gaya district court but not before engaging in a brawl with police who had come to Patna to detain him.
Rocky's surrender comes a day after the Supreme Court cancelled the bail granted to him by Patna High Court on October 19.
Rocky and his father Bindi Yadav arrived in Patna airport from Delhi, where they had gone for the apex court hearing, around 7.45 this morning.
A police team from Gaya had reached Patna airport to take Rocky into their custody. But Rocky, Bindi and one Jacky Yadav, an acolyte of the boy's family, protested, saying they were on way to Gaya to surrender as per the Supreme Court directive.
However, the police team, led by Gaya police sub-inspector G.S. Gupta, was adamant on detaining Rocky. The road rage accused though avoided the police dragnet and made his way to Gaya on his own.
The Gaya police filed a complaint at the Airport police station in this connection. "Based on the Gaya police complaint, a case has been registered against Rocky, his father Bindi Yadav and one Jacky Yadav on charges of hindering government work. The three have been booked under sections 186, 353 and 506/34 of the Indian Penal Code," an officer of the Airport police station officer said on condition of anonymity as he is not authorised to speak to the media.
Around 11am, Rocky surrendered in the court of Gaya additional district and sessions judge IX Suresh Prasad. Rocky was sent to Gaya central jail on judicial remand for 14 days. His mother Manorama Devi, a suspended JDU MLC, was present in court.
Gaya senior superintendent of police Garima Malik justified the police team's decision to go to Patna to detain Rocky. "The standing council of the Supreme Court sent a letter to Gaya police on Friday in which it asked us to produce Rocky before the court. The police team that had gone to Patna airport was carrying a copy of the letter. But Rocky and his father did not cooperate with the police and created hurdles in discharging our duty," she said.
After surrendering, Rocky said he had faith in the judiciary. "I have great respect for the court like we respect our mother. I have faith in the courts just like a son trusts his mother. I am not guilty in the killing of Aditya and the charges against me are baseless," he said.
Rocky is accused of shooting Aditya on May 7 when travelling on the Bodhgaya-Gaya road. Aditya was in a Maruti Swift car with four friends. Rocky, who was in his Land Rover, was enraged when his vehicle was denied right of way by the driver of the Swift.
According to the testimony of eyewitnesses, Rocky allegedly fired a warning shot forcing Aditya and his friends to stop. However, later he fired again, this time the bullet piercing the rear windshield of the Swift and hitting Aditya who was on the backseat.
Rocky was arrested well over 50 hours after the incident from a factory owned by his father in Gaya's Mastpur village.
