Patna, March 7: Patna High Court today reserved its judgment on a petition filed by Kundan Prasad Singh seeking a CBI probe into the alleged fake encounter of his son, Rahul Raj.
Rahul was allegedly killed by Mumbai police in a fake encounter in October 2008. Justice S.N. Hussain reserved the judgement after hearing the arguments of both sides in the case.
Contending that Rahul was killed in a fake encounter October 27, 2008 in Mumbai, Singh’s counsel Raj Kumar submitted before the court that Kundan Prasad Singh, the petitioner, had on December 1, 2008 sent representations to the Maharashtra chief minister and Mumbai police commissioner seeking justice. The petitioner also requested the Mumbai police to give him the post-mortem report, forensic report and a CD of the videographed post-mortem of Rahul but the Mumbai police did not oblige him, Kumar added.
On the other hand, Maharashtra’s counsel Ehsan Amanullah challenged the high court’s jurisdiction to hear the matter and said the high court did not have jurisdiction to hear the matter as the cause of action arose in Mumbai and hence the petition before the court was not maintainable.
Refuting the Maharashtra government’s counsel, the petitioner contended that the body of Rahul was handed over by Mumbai police to his father in Patna and hence the cause of action arose here.
The high court had earlier directed the CBI, Maharashtra and the central government to file a counter affidavit to the writ petition seeking a CBI or judicial probe into the encounter.
BCCI reply sought
Patna High Court today directed the Board of Control for Cricket in India (BCCI) to file its reply on a petition filed by Bihar Cricket Association (BCA) seeking direction to allow the latter to operate its Bank of India account.
A bench of Justice S.N. Hussain gave BCCI time till April 4, which is the next date of hearing. The court has asked the body to clear its stand with regard to the claim of BCA and Lalu Prasad-led ad hoc committee being the original one. BCA’s bank account lies with Bank of India.
