CBI probe order

The high court today directed the Central Bureau of Investigation (CBI) to register a case and conduct an inquiry in a case in which a person, arrested with 277kg of ganja, sought bail by furnishing forged documents.

Patna, July 5: The high court today directed the Central Bureau of Investigation (CBI) to register a case and conduct an inquiry in a case in which a person, arrested with 277kg of ganja, sought bail by furnishing forged documents.

Justice Shivaji Pandey passed the order while hearing a criminal miscellaneous petition filed by one Subodh Kumar and three others seeking bail. While Subodh belongs to Vaishali, the two other accused, Nawal Kumar Sahni and Noor Alam, hail from Assam.

In 2015, directorate of revenue intelligence (DRI) officials had intercepted the trio and seized huge quantity of ganja from their possession. The trio were charged under relevant sections of the Narcotic Drugs and Psychotropic Substance Act (NDPSA).

However, in the bail application, the prosecution report was annexed in which recovery was shown as 7kg of ganja. The court had granted bail to the petitioners considering the quantum of ganja.

During the earlier hearing proceedings, senior advocate N.K. Agrawal, appearing on behalf of Subodh, had brought the same to the notice of Justice Shivaji Pandey.

Justice Pandey said in his order: "Agrawal landed at my office and informed me that some fraud had been committed in obtaining the order, whereupon I directed the registrar general through an administrative order for production of original records related to the case."

Advocate Agrawal then filed an affidavit in the court in which he averred that he was handed over the file in court and without verifying the statement, he had argued the case.

"The original records were brought by Mohammad Ghulam Gaus, additional district judge XI, Patna which was produced before me. On perusal of the original records, it appears that 277kg of ganja has been recovered from the accused but they have manipulated the prosecution report," said Justice Pandey, adding: "It is completely a case of fraud."
