The BJP on Sunday said the state government is "half-heartedly" approaching the Supreme Court against Mohammad Shahabuddin's release on bail from Bhagalpur central jail.
The Nitish Kumar government on Friday moved the Supreme Court challenging a Patna High Court order granting bail to former parliamentarian Shahabuddin. Slamming the government, Bihar BJP leader and former deputy chief minister Sushil Kumar Modi said: "The government approaching the Supreme Court against Shahabuddin's bail is just an eyewash. The government has filed the petition with incomplete documents."
According to the BJP leader, the government has moved the Supreme Court without the certified copy of the September 7 Patna High Court order.
Also, the government has not submitted the official translation (OT) copy of lower court proceedings at the apex court.
Senior advocate Prashant Bhushan, too, has filed a petition in the Supreme Court for the cancellation of Shahabuddin's bail.
The Supreme Court has clubbed both the petitions slated for a hearing on September 19 in court of Justice Pinaki Chandra Ghose and Justice Amitava Roy.
The Bihar government's petition mentions exemption from filing certified copy of the impugned judgment and exemption from filing official translation.
However, legal experts said it is just procedural and not going to affect the merit of the case.
Vindhyachal Singh, a senior advocate at Patna High Court, said: "The Bihar government's petition seeking exemption from filing certified copy of the impugned judgment and exemption from filing official translation is not going to affect the merit of the case."
Echoing the views of lawyer Vindhyachal Singh, another high court lawyer Dinesh Kumar said: "Both Chanda Babu and the Bihar government's prayer is on same ground. Petitioner Chanda Babu's counsel Prashant Bhushan must have submitted the necessary documents in the case."
The BJP leader also alleged that the Bihar government, by filing a petition challenging the high court order, is into theatrics.
Modi said: "As Prashant Bhushan has filed a case against Shahabuddin earlier than the Bihar government, they have just walked on his footprint to save their image."
