Patna: Special excise judge Ramesh Chandra Malviya on Thursday rejected the regular bail petition of Tiandong Wo a.k.a Danny, a Chinese national arrested on the charge of possession of liquor.
Danny was arrested on June 17 this year from a guesthouse in the Gardanibagh area by a Patna police team that had raided the Oppo Mobile guesthouse and found two liquor bottles, including one of a Nepalese brand, from Danny's room.
His counsel told the court that Danny's visa is valid till June 21 this year, and if his visa validity expires then he might be accused of other criminal charges.
Special public prosecutor Sayyed Zafar Haider opposed the bail petition and told the court that the visa deadline should not be the basis for granting bail.
A senior official from the Chinese consulate in Calcutta had come to Patna last Monday and told the cops that his countrymen were not aware of prohibition in Bihar.
"I am sorry that a citizen from my country has violated the rules of your state," Wang Lifeng, economic & commercial consul at the Chinese consulate in Calcutta, had told Gardanibagh police station house officer C.P. Yadav. "Please provide us the list of dos and don'ts that a person - especially a foreigner - has to follow in your state. Also provide us a list of what to drink and what not to drink," he had said.
Danny has been booked under Section 38 (i) (II) of Bihar Prohibition & Excise Act, 2016. If found guilty, he faces a maximum of 10 years in prison.
During the raid at the four-storey guesthouse on Sunday, a liquor bottle was also recovered from the room of another Chinese national, Wu Chuangyong, who was away in Bhagalpur.
The police have asked Wu Chuangyong to surrender.
