Fake lawyer's plea rejected

The high court on Monday cancelled the anticipatory bail of Jasmeer Hussein, who had been practising in lower courts by falsely identifying himself as a lawyer and has been accused of preparing a fake gift deed.

The Barrackpore resident had been granted anticipatory bail three months ago when Jasmeer was fearing arrest on the charge of drafting the allegedly fake deed.

The bail was cancelled after the court went through a report of the state bar council, which stated that Jasmeer was not a lawyer.

Police records state the “gift deed” Jasmeer had prepared had helped Khardah resident Ashok Dutta grab a two-and-a-half-cottah plot owned by his brother Bikash and three sisters.

Bikash, who runs a medicine shop in Khardah, had lodged a police complaint on July 10, 2009, detailing the alleged forgery and mentioning Jasmeer as the “lawyer” who had prepared the deed.

The Khardah police started a case against both Ashok and Jasmeer, prompting the “lawyer” to move the high court for anticipatory bail.

The high court granted his prayer on November 17 last year on the ground that he was a “lawyer”.

Bikash then approached the Right to Information commissioner, seeking to know whether Jasmeer’s name had been registered with the state bar council.

“The commissioner had forwarded the application to the bar council, which sent a report in December stating that the registration number Jasmeer had been citing as his for the past five years was fake,” Bikash’s lawyer told the high court when his plea for cancellation of the anticipatory bail was taken up on Monday.

The lawyer, who placed the council’s report in the court, also said a gang had fired at his client on the night of January 8 when he was returning home along with one of his employees.

“My client had a narrow escape but his employee was injured,” he said.

A day before, the lawyer added, Bikash had conveyed to Jasmeer the bar council’s findings.

“My client has lodged an FIR alleging that Jasmeer had masterminded the attack.”

After hearing the submission, Justice Asim Banerjee cancelled the earlier order.
