Cuttack, July 12: High court today refused to consider on the necessity of a CBI probe into the death of Hindol panchayat samiti chairman Nabaghana Sahu on allegations of the involvement of women and child development minister Anjali Behera. The accusing petition did not name her as one of the opposite parties.
Dhenkanal Nagarika Mancha convener Prasanta Kumar Mishra and nine others had filed the PIL naming the state home secretary, DG and ADG of police, CID crime branch, Dhenkanal SP and CBI SP as opposite parties.
The court, however, neither rejected the petition nor issued any notice. It allowed the petitioner counsel to file a modified petition. “The bench of Chief Justice V. Gopala Gowda and Justice B.N. Mohapatra said it is open for the petitioner to name as an opposite party the person against whom the allegation has been made and directed for putting up the PIL next week,” petitioner counsel D.K. Mohapatra said.
Nabaghana Sahu of Biju Janata Dal died on May 14 after being hit by a jeep while he was walking from his cashew field 1.5km away from his village Ganjara. Nabaghana’s brother Muralidhar alleged that he was murdered and lodged an FIR at the Rasol police station suspecting the involvement of four persons.
