Cops detect fake bail case

Cuttack, May 25: A suspected forgery case involving use of fake anticipatory bail order of the Orissa High Court for nine persons in a kidnapping case has come to light.

The case was detected after the main accused applied for anticipatory bail.

The kidnapping case was registered at Bolagarh police station in Khurda district on January 7, 2011, following a complaint lodged by a resident of Dibyasinghpur, which alleged that his minor daughter had been kidnapped.

The father, Munis Behera, is from the same village as the main accused and nine others as co-accused.

Police had since declared 28-year-old Munis as an absconder.

On behalf of Munis, an anticipatory bail application was filed in the high court. His counsel submitted that other co-accused persons’ had been released on bail by order of the high court. He allegedly produced an order granting the co-accused persons bail before the SDJM, Khurda.

But on inquiring the copying department of the high court, it was revealed that no such bail order had been issued.

Vacation judge S.C. Parija ordered for production of lower court record of the co-accused persons who had reportedly got released by producing the purported high court order.

The vacation court further empowered additional government advocate V. Narsingh to implement the order.

The court suspected forgery. “If found so it would be handed over for investigation by the Crime Branch,” justice Parija said, while directing for putting up the matter after summer vacation.

The nine persons named co-accused in the kidnapping case included six family members of the main accused.

In March 2008 a dacoity case accused had got himself released on bail by producing purported bail order of high court at a lower court in Kendrapara. In August 2006 a purported bail order by the high court was submitted at a lower court in Burla for bail of three accused persons in a murder case.
