New Delhi, March 1: Controversial Congress MP from Assam?s Tezpur constituency, Mani Kumar Subba, is in hot water over a court case.
The Supreme Court has issued notices to Subba, the Union home ministry, the CBI and the Election Commission on a public interest litigation (PIL) which has levelled several serious charges.
He is alleged to be a Nepali citizen with a proven criminal track record. These include a murder charge, conviction for murder by a trial court in Nepal and electoral malpractice. He continues to be an MP though his name has not been included in the voters? list owing to his nationality and is still registered as a voter in Nepal, the PIL claimed.
A three-judge bench of Chief Justice R.C. Lahoti and Justices A.R. Lakshmanan and A.K. Mathur issued the notices on the contention of advocate Ambhoj Kumar Sinha for petitioner B.N. Singh.
The litigation wants Subba unseated as a Lok Sabha MP and deported to Nepal to undergo conviction in the murder case there. The PIL is slated for hearing on Friday.
Subba had allegedly escaped from Nepal and entered Sikkim when it was not part of India. He was chased away from there and entered Tinsukia under an alias. His real name, the petitioner claimed, is Mani Raj Limbo. ?His father is one Dhan Bahadur Limbo and even now he is a registered voter in Dhobi Ghat village of Kathmandu district,? said Sinha while seeking action against Subba.
In Tinsukia, Subba metamorphosed from a petty criminal with a murder conviction to a well-networked contractor earning annual profits of over 40 crore. ?In most of his contracted works, he raised fake bills and pocketed the money,? the petition claimed.
The petition said Subba?s firm was involved in the Rs 25,000-crore Meghalaya lottery scam.
The comptroller and auditor general?s report later exposed irregularities in the Nagaland lotteries as well, also conducted by Subba?s firm.
