Dimapur, Aug. 1: The Election Commission today forwarded a Supreme Court order and directed Nagaland chief electoral officer Abhijit Sinha to instruct the returning officer to incorporate the July 28 apex court's order in the declaration of the result of the byelection to the 10-Northern Angami-1 (ST) Assembly constituency under Kohima district.
Sources said the under secretary, Election Commission of India, Navin Kumar, has written to Sinha, directing him to forward a copy of the July 28 order of the Supreme Court in SLP (C) No 18701 of 2017 (Nagaland PCC Vs Election Commission of India & Anr.) which inter-alia held that, "the result of the election would be subject to the final outcome of the instant special-leave petition".
The Supreme Court issued its order to the Election Commission to take necessary action in the special-leave petition filed by the Nagaland PCC against the poll panel in connection with the byelection held on July 29.
Former chief minister and NPF president Shürhozelie Liezietsu and Independent candidate Kekhrie Yhome were in the fray.
The order said the chief electoral officer should issue necessary instructions to the returning officer, Rajesh Soundararajan, who is also the deputy commissioner of Kohima, to incorporate the apex court order in the declaration of the bypolls results to the 10-Northern Angami-1 constituency where counting is scheduled for Thursday.
