Ranchi, Aug. 4: Jharkhand High Court today dismissed a petition filed by one former BIT-Mesra architecture student, who had challenged the cancellation of his provisional admission to the premier institute.
Harshvardhan S. Saini moved high court after BIT-Mesra cancelled his provisional admission on January 6, 2010. Harshvardhan, who had appeared in CBSE Class XII board exams in 2009 in the science stream, had secured an overall 73 per cent, but failed in mathematics with 23 per cent marks.
But before his board results were out, Harshvardhan competed in the All India Engineering Entrance Examinations (AIEEE) and secured an all-India rank of 1510. Through counselling, he bagged admission to B.Arch in BIT, Mesra.
According to CBSE rules, Harshvardhan could clear his math paper subsequently, and in fact, was granted provisional admission on that basis.
The youth did appear in the math compartmental exams held in December 2009, but did not inform this to the BIT-Mesra administration. He also could not produce a CBSE pass certificate.
The counsel for BIT-Mesra said it was mandatory for a student to secure 60 per cent in English and math for admission in the institute’s B.Arch course, but Harshvardhan had failed in math in 2009. Subsequently, he also could not produce a pass certificate.
Justice Poonam Srivastav observed that since Harshvardhan could not produce a final pass certificate within a reasonable tenure, BIT-Mesra had no option but to cancel his provisional admission. The court, while rejecting Harshvardhan’s plea, also said an institute must follow its own regulations regarding admission.
