Memon, the lone man sentenced to death in the case, has moved a fresh petition in the Supreme Court seeking a stay on his death warrant on the grounds that it was issued in violation of the apex court's guidelines.
The warrant was issued on April 30 before he had filed the curative petition against the death sentence, he said. The apex court had laid down in an earlier judgment that a death warrant should not be issued until all legal and executive remedy options are exhausted, he said.
Memon has pleaded that he has filed a fresh mercy petition before the governor. The earlier plea, rejected by the President, was filed by his brother.
When he was sentenced to death in 2007, Memon had told the Tada court he had "not spent a single day with his daughter in her entire life". She was born days after his arrest in 1994.
