Patna, Aug. 19: The high court today dismissed petitions seeking re-evaluation of answer sheets of students who flunked the Central Board of School Education (CBSE) Class XII examination.
After perusing the rep- ort furnished by a three-member committee, the bench of Justice Ajay Kumar Tripathi dismissed the petitions by Class XII students of CBSE-affiliated schools alleging irregularities in the results published by the board.
The committee, in its report, submitted that there has not been any irregularity in awarding marks to anyone, including the petitioners.
It may be noted that the court had on July 29 constituted the three-member committee, comprising head of the department of mathematics, Patna University, additional director-general of police Abhayanand, who also coaches students preparing for IIT-JEE, and a representative of CBSE chairman, to probe the allegations made by the students. The panel was asked to furnish the report within three weeks. The students had approached the high court after the CBSE did not heed to their representation in which they had alleged irregularities in the Class XII examination results, declared on May 27.
According to the report furnished by the CBSE in the court, about 13,000 students failed in the examination, of which, around 11,000 students flunked in mathematics alone.
Appearing for one of the petitioner students, senior advocate Y.V. Giri, submitted that CBSE refused to conduct re-evaluation of the answer sheets, saying it could, at best, do re-totalling of marks.
Giri contended that the answer sheets should be re-evaluated as the copies were evaluated by those who did not fulfil the requisite criteria enumerated under the board’s rules.
According to the board rules, head examiner must be in the rank of principal or vice-principal with postgraduate qualification whereas examiner should have at least three years of teaching experience with a postgraduate degree.
It was found that papers were evaluated by teachers of primary schools which was a clear-cut violation of the CBSE regulation, Giri had said.
