Patna, May 9: The BJP today accused former CBI director Ranjit Sinha of helping RJD chief Lalu Prasad in the fodder scam case.

Senior Bihar BJP leader Sushil Kumar Modi quoted from Monday's Supreme Court judgment, in which the apex court slammed the Central Bureau of Investigation for delay in challenging the Jharkhand High Court verdict of 2014 that had said that separate fodder scam cases cannot be heard, to accuse Sinha of being "biased".

The Supreme Court turned down the high court judgment and directed separate trial in four cases in which Lalu is an accused.

The CBI, the apex court had commented, "has failed to live up to its reputation.... Let the director of CBI look into the matter and saddle the responsibility on a person.... Responsibility for delay in such cases to be termed as deliberate one which is intolerable".

Going by the SC observation, Modi said, it becomes clear that the CBI didn't do its bit in the case.

"We had moved Patna High Court seeking removal of Sinha, who was DIG (deputy inspector-general) in CBI at that time, as he was favouring Lalu during the investigation," Modi alleged.

"Our petition has led to his removal from the investigation in the case even though the Patna HC had allowed him to continue at the post of CBI DIG."

Modi also alleged that Lalu had played "an instrumental role" in making Sinha director-general of the Railway Protection Force in 2008 while the RJD chief was the railway minister and later used influence in the UPA to make Sinha CBI director in 2012.

Sinha - a retired IPS officer against whom an FIR was lodged on April 26 this year for allegedly trying to influence the investigation in the coal block scam case - refused to comment on the BJP leader's claims.

Modi accused chief minister Nitish Kumar of making an "opportunistic" alliance with Lalu to cling to power despite knowing the corruption charges the RJD chief.

"Bihar is paying the price of this alliance in terms of rampant corruption and deteriorating law and order situation," Modi said.

He also criticised Nitish for sending an emissary to Arvind Kejriwal, as reported by a section of media, to express solidarity with the Delhi chief minister.

"The same Nitish Kumar fielded his candidates against AAP in the MCD polls but when Kejriwal is facing corruption charges, he is trying to befriend him," Modi said.
