Suri, Jan. 7: Birbhum chief judicial magistrate Indranil Chatterjee, who was allegedly assaulted by a group of youths demanding Kali Puja subscription last year, submitted a petition in a Suri court today expressing dissatisfaction over the police probe in the case.

Chatterjee said the police were yet to give him a copy of the FIR and had delayed collecting evidence.

Chatterjee was allegedly assaulted and his T-shirt torn by some drunk youths who stopped his car in Suri town on November 8. The police had arrested four youths a day after the incident, triggering protests by residents who accused the cops of making "wrong arrests".

The four youths, hired by a decorator to make the Kali Puja pandal, were subsequently released on bail.

Additional chief judicial magistrate Deb Kumar Goswami today observed that not giving the complainant a copy of the FIR was "gross violation of the CrPC". He sought a written explanation from the inspector in charge of Suri police station tomorrow.

"Why? It is gross violation of the CrPC by the police. Why did the police not provide a copy of the FIR?" Goswami asked. "The inspector in charge will have to explain the reason behind it in writing by 1pm tomorrow."

In another part of the petition, Chatterjee alleged that the police had collected his torn T-shirt 10 days after the incident. He said the T-shirt was an important piece of evidence.

"It's clear that the police are not carrying out the investigation properly," the petition said.

"The police did not arrest the actual miscreants. They put up some other persons in the TI (test identification) parade with some malafide intention," the petition added.

Chatterjee also demanded copies of the statements made by the arrested persons. But the ACJM disallowed it saying there was no such provision in law.

Chatterjee's lawyer, Prithwish Ganguly, then requested the court to monitor the investigation, which also was turned down by the court.

Asked later about Chatterjee's petition, a police officer in Suri said: "He did not ask for a copy of the FIR. We admit there was a delay in collecting the T-shirt. But we were busy conducting raids in search of the culprits."

Regarding the allegation that the actual culprits were not arrested, the officer said: "Our investigation is on."
