Alipore: Singer Debojit Dutta, arrested last month on the charge of raping a woman and making a false promise to marry her, was acquitted on Monday.
The court quashed the charges against him based on the final report police submitted.
The court has instructed the complainant, a 30-year-old woman, to remain present at the next hearing and explain why she had filed the case.
Dutta was released after spending almost a month in jail because the police didn't find any evidence that he had committed a crime.
Officers of Jadavpur police station had arrested Dutta, 32, on March 20 based on the woman's complaint.
"In light of the new development, we submitted a plea seeking the court's permission to start a case against the complainant under Section 211 of the IPC because her intention behind filing a false complaint appears to be malicious," public prosecutor Prabir Chatterjee said.
The court accepted the plea and ordered the complainant to remain present at the next hearing.
Section 211 of the IPC deals with false charge of offence made with the intent to injure.
If the woman fails to give a satisfactory explanation for her action, she could be prosecuted. The charge carries a maximum punishment of seven years in jail and fine.
Dutta first came into the limelight after qualifying in the top 30 in the first season of Indian Idol.
