Cuttack, May 8: Orissa High Court has urged the authorities not to overlook cases where allegations are raised against school headmasters, as this may disrupt the entire education system.
The court allowed the state government's petition challenging an order in which the State Administrative Tribunal (SAT) had quashed the transfer order of a headmaster.
The case pertained to the transfer of Minarva Dash, headmaster of Kunjabihari Jew High School in Cuttack city to Dadhibaman Jew Bidtamandir at Gholpur, 55km away.
The authorities had taken the decision to transfer her on administrative ground after confirmation of allegations on inquiry.
A division bench of Justice Sanju Panda and Justice S.N. Prasad held that a headmaster, being the head of the institution, could not be allowed to mismanage the school. The court endorsed the transfer on administrative ground.
"If any allegation is levelled against the head of the institution, that too against the incumbent who is holding the post of headmaster, who is supposed to maintain administration in all respects of the school, the authority cannot be said to be silent spectator otherwise the entire system of the school will collapse," the judges observed in the April 27 order, a copy of which was available today.
The judges held the view that the Tribunal had passed order which "cannot be saidto be in consonance with the settled proposition of law".
"Hence we are not in agreement with the same. Accordingly, the order passed by the Tribunal is set aside," the bench observed.
Earlier, Minarva was transferred from Sahid Smruti Bidyapitha, Barang, to Kunjabihari Jew High School on June 4, 2012, after she made a representation for transfer on the ground that she was suffering from serious cardiac disorder.
The transfer order to Dadhibaman Jew Bidyamandir at Gholpur was issued on June 12, 2015.
