Cuttack, Dec. 8: A day after Priti Mohanty’s petition was accepted by the family court in Bhubaneswar, the model studying journalism has turned to Orissa High Court to prevent Dushmant Panda from getting anticipatory bail.
Priti has been claiming conjugal rights over the actor.
Dushmant had filed an application for anticipatory bail after a case was registered against him on the basis of a complaint filed by the 24 year-old-girl.
Priti’s counsel Smruti Ranjan Mohapatra told The Telegraph: “An affidavit was filed on behalf of her in the high court today opposing the anticipatory bail application filed by Dushmant Panda against whom a case has been registered at Mahila police station in Bhubaneswar.”
Cancellation of the bail petition by the actor has also been sought.
“We have opposed anticipatory bail on the ground that there is chance of tampering with evidence by Dushmant as a prima facie case is made out against him under sections 493 (cohabitation caused by a man deceitfully inducing a belief of lawful marriage), 341 (wrongful restraint), cheating (417), 294 (wrongful restraint), 506 (criminal intimidation) and 34 (acts done by several person) of the Indian Penal Code,” Mohapatra said.
Priti’s counsel refused to give further details in the affidavit as the “matter is sub judice”.
Priti moved the family court on November 29 after Dushmant had refused to recognise her as his wife and said he was already married to actress Kajal Mishra. She had also filed an interim application, seeking an order from the court not to recognise the marriage of Dushmant and Kajal.
Earlier on November 27, Priti had staged a protest at Kajal’s marriage reception party in Bhubaneswar, demanding the actor’s arrest. She had also lodged complaint with the Odisha Commission for Women and staged dharna outside Mahila police station and Dushmant’s house.
