HC seeks report in Mishra case

Cuttack, Dec. 9: Orissa High Court today directed the state vigilance to disclose the practice, adopted by the Odisha State Police Housing and Welfare Corporation, regarding procurement of steel and cement from suppliers or manufacturers.

The court was hearing the petition, filed by former director-general of police Prakash Mishra, currently working as the Union home ministry's special secretary,who had challenged the case registered against him by the state vigilance under the Prevention of Corruption Act.

At present, Mishra is the special secretary of internal security at the Centre.

The court wanted to know the practice and procedure that were adopted by the corporation prior to Mishra joining as its chairman-cum-managing director on September 1, 2006 and after he demitted office on July 3, 2009.

The single judge bench of Justice S.C. Parija set a two-week deadline for the state vigilance to file an affidavit on it.

The FIR had been registered against Mishra for alleged undue favours shown to various steel and cement suppliers during his tenure in the corporation between 2006-07 and 2009-10.

The state vigilance had registered the case on September 20, alleging that undue favours were shown by way of making 100 per cent payments of Rs 57.86 crore prior to the supply of cement and steel within the stipulated period.

In pursuance of the court direction on November 19, the state vigilance today submitted in a sealed cover the audit of the corporation's accounts for 2006-07 to 2009-10. Besides, the vigilance also submitted copy of the audit reports, along with that of the resolution of the corporation's board of directors, related to such audit reports.

Justice Parija, however, refused to accept it as it was not submitted along with an affidavit on it and ordered for listing of the case after the court reopens after winter vacation.

Justice Parija further clarified that the interim orders would be effective till disposal of the case. The court on October 13 had issued an interim order, which stated: 'In the interim no coercive action shall be taken against the petitioner (PrakashMishra) in connection with vigilance case pending in the Court of Special Judge, Vigilance, Bhubaneswar, till next date (October 29).'

Mishra is being tipped to take over as the chief of the Central Reserve Police Force.
