New Delhi/Dehradun, May 11 (PTI): Harish Rawat is expected to be back as Uttarakhand’s chief minister, with the Supreme Court on Wednesday clearing the results of the floor test it had ordered in the legislature after Rawat challenged the March 27 dismissal of his Congress government via President’s Rule.
“Rawat gets 33 votes out of 61 in the floor test. No irregularities were found in the voting. Nine MLAs could not vote due to their disqualification,” a bench of Justice Dipak Misra and Shiva Kirti Singh said.
The bench said President's rule should be revoked so that Rawat can assume office as Chief Minister.
Celebrations broke out in Dehradun the moment the news trickled in from the court that Rawat has won the trial of strength in the Assembly on Tuesday, which was carried out on the instructions of the Supreme Court.
The Bharatiya Janata Party’s government at the Centre had imposed President’s rule after nine Congress rebels sided with the BJP on a key piece of legislation in the state assembly.
The Speaker disqualified the nine rebels, who then challenged the decision in the high court and lost. The rebels appealed to the Supreme Court, which declined to interfere before the trust vote.
On Wednesday, the Supreme Court bench announced the results after studying the records filed by Uttarakhand’s Principal Secretary for Legislative and Parliamentary Affairs, who had supervised the trust vote under the court’s order.
Attorney General Mukul Rohatgi conceded that there is no doubt that Harish Rawat has proved his majority.
“It is clear that respondent number 1 (Harish Rawat) has proved the majority on the floor of the house. I have received instructions from the Centre on the issue. The instructions are that the Centre will revoke the President's rule,” the AG told the bench.
Senior Advocate Kapil Sibal, appearing for Rawat, said: “It's a fair decision.”
The bench said Harish Rawat is to assume office as chief minister after President's rule is revoked. “We allow the Centre to revoke forthwith the order of proclamation of President's rule in the state,” it said.
The bench asked the Centre to file before it day after tomorrow its order revoking the President's rule.
