New Delhi: The Supreme Court on Tuesday adjourned hearing of a PIL seeking prosecution of Prime Minister Narendra Modi and then defence minister Manohar Parrikar in connection with the Rafale deal that is alleged to have caused a loss of Rs 12,000 crore to the national exchequer.

A bench of Justices Ranjan Gogoi, Navin Sinha and K.M. Joseph adjourned the hearing indefinitely after advocate M.L. Sharma, the petitioner, sought such a deferral on the ground that he wanted to place some additional documents on record.

Justice Gogoi pointed out that Sharma had "circulated" a letter saying he was "unwell", and wondered how he was now seeking adjournment on the ground of filing additional documents.

"Now you are talking about filing an additional affidavit and documents. But you have circulated a letter seeking adjournment saying you are unwell," Justice Gogoi, heading the bench, observed.

In his petition, Sharma had pleaded that the inter-governmental agreement with France to buy 36 Rafale jets "must be quashed as it is an outcome of corruption" and not ratified by Parliament as per Article 253 of the Constitution.

Besides Modi and Parrikar, the petitioner wanted the prosecution of industrialist Anil Ambani for his alleged involvement in the deal.
