Jamui, Nov. 16 (PTI): Former Union minister Jai Prakash Narain Yadav, who lost his ministerial berth recently after a non-bailable arrest warrant was issued against him for securing the ?illegal? release of his brother Vijay Prakash, failed to get relief from a district court today.
Dismissing Yadav?s criminal revision petition, Jamui district and sessions judge Muneshwar Prasad upheld the October 24 order of chief judicial magistrate (in-charge) S. Srivastava by which a non-bailable warrant was issued against the former Union minister.
Earlier in the day, the judge had reserved his order after hearing Yadav?s advocates and the government counsel.
A battery of lawyers, including Supreme Court advocate S.K. Jain, assisted by Patna High Court advocates Rana Pratap Singh and C. Sinha, defended Yadav.
With the dismissal of his petition today, Yadav, who continued to evade arrest, seems to have hit a wall.
Yadav?s lawyers described the Jamui CJM?s move to issue a warrant against the RJD leader as ?hasty and injudicious? and prayed that the order be quashed.
Besides, they also sought deletion of Section 409 of the Indian Penal Code, applied against Yadav by police with ?mala fide? intention.
Government lawyer Abdul Saki defended the police action, arguing that they had every right to include any section for a ?thorough? probe.
Yadav was charged with securing the ?illegal? release of his brother, who was arrested while moving in Jamui constituency with arms, cash and liquor on October 18.
Yadav had to resign from the Union ministry after the NDA mounted pressure on the Centre for his ouster.
