Purnea, March 29: Chief judicial magistrate Daya Lal Prasad heard a protest petition filed by Rupam Pathak, the main accused in the murder of BJP legislator Rajkishore Keshari, and declared it to be a fresh complaint case.
He postponed the next date of hearing to March 31, after hearing the petition.
Rupam had filed the petition on September 16 last year against the final police report on case number 182/2010, which was closed for want of evidence.
Rupam had accused both the legislator and his personal secretary Bipin Rai of raping her.
Sources said the Central Bureau of Investigation, which is now in charge of investigating the case, has taken Rai’s blood sample for the purpose of further investigation.
He was also grilled by the Central Bureau of Investigation before he left for Siliguri two days before Holi.
Rai, however, denied that the CBI had taken his blood sample.
The Central Bureau of Investigation had also quizzed Rupam’s mother Kumud Mishra and seized Rup- am’s clothes and diary as evidence to sustain the case of sexual assault, said her lawyer Dinesh Kumar.
Opposition parties and women’s organisations have been demanding Rai’s arrest, after Keshari’s murder in January.
