Gaya: Patna High Court, while disposing of a case on August 24, observed that "transfer on the recommendation of political person namely Member of Legislative Assembly/Member of Parliament is held to be unsustainable".
Quoting an earlier judgment of the division bench of the high court, Justice Anil Kumar Upadhyay in a six-page order quashed the transfer of Gaya College principal Dinesh Prasad Sinha to the same post in SS College, Jehanabad.
On July 28, Magadh University vice-chancellor Qamar Ahsan, on the direction of the chancellor's office, transferred the principals of Gaya College and SS College.
The two principals were transferred back to their previous positions on the basis of a complaint made by Aurangabad MP Sushil Singh. The transfer order was challenged in court by Dinesh Prasad Sinha.
Through a complaint addressed to the governor-cum-chancellor, the Aurangabad MP, on June 19, said the senior-most principal should be entrusted with the responsibility of a big college like Gaya College. Dinesh Prasad Sinha was not the senior-most among the principals and in 2013, he had figured in the ninth place in the seniority list of principals.
Moreover, the character of Sinha has been questionable and allegations have been made against him in the past. Moreover, he had contested Assembly and Council elections as an RJD candidate, said the MP's letter. The petition requested the chancellor to intervene in the matter and take seniority as prime consideration in the deputation of principals.
On the basis of the MP's letter, the chancellor's office, on July 27 directed the MU VC to hold inquiry against Sinha on the charges levelled against him and in the meantime, transfer the principal back to the position as the SS College principal.
