Siliguri, March 2: A court today directed a deputy superintendent of police to investigate the charges of ransacking and torturing a Congress supporter and his wife allegedly by three law enforcers at Matigara on February 10.

Anjana Dhar had filed a suit against three police officers — Biswajit Das, the then circle inspector of Bagdogra, Debasish Bose, the officer-in-charge, and Kaushik Karmakar, a sub-inspector, both from Matigara police station.

“They had illegally entered our house and bedroom, abusing us in filthy language,” Anjana had said in her complaint lodged in the third week of February. “The officer-in-charge caught hold of my night dress and, as my husband protested, he slapped me and took away my gold chain. The two other accused started beating my husband and dragged him out of the house. Karmakar snatched another gold chain my husband was wearing.”

On that night, the three officers had entered the Dhars’ residence at Matigara, 4km from here, and picked up the Congress supporter from his house for allegedly hurling bombs at a police vehicle.

According to the complaint, Dipendu was taken to Matigara police station, where he was beaten up in the custody. Next day, when he was produced in court, his bail plea was rejected but the additional chief judicial magistrate ordered his medical check-up which indicated serious injuries suffered within 24 hours. In her suit, Anjana brought charges of theft, voluntarily causing hurt, trespassing or house-breaking at night, assault or criminal force on woman with an intent to outrage her modesty and criminal conspiracy against the three police officers.

Today, the judicial magistrate first court, R.N. Makal, ordered Sitaram Sinha, the deputy superintendent of police of Siliguri, to probe the charges.

“The court order also states that the DSP has to submit the report within a fortnight from the date of receipt of the order. He cannot delegate this power to any of his subordinates for investigating the case,” a lawyer said.
