Ranchi, Sept. 3: A case has been filed at the district consumer forum against a city-based developer over deviation from construction plan and failure to serve as per the agreement with the complainant.
Manoj Kumar Mishra has alleged that Bansal Constructions, which had developed his property, did not adhere to its commitment while developing his flat in Binoy Shanti Priti Apartments on Kanke Road.
While hearing the case today, the district consumer forum fixed the next date of hearing on September 29 for appointment of a pleader commissioner. Mishra had filed a petition through his counsel Arbind Kumar earlier this April seeking a pleader commissioner for spot inspection of the building to identify the low quality of material and non-compliance of the agreement.
Mishra’s mother had entered into an agreement with the company in January 2005 for converting the property into a residential apartment. After her death, the agreement was renewed between the two sides, with Mishra and his father replacing his mother.
According to the agreement, Bansal Constructions had to install a CCTV camera in Mishra’s flat but has failed to do so. Mishra argued that the company was also supposed to install an EPABX telephone system, exhaust fan in the kitchen, water filtration plant, rainwater outlet, gate lights, paint the balcony, corridors and grills next to the front door and provide proper wiring.
Mishra has claimed Rs 5.2 lakh as compensation for harassment and deficiency of service on the part of the builder.
The company has, however, refuted the allegations saying the flat was handed over to Mishra in January 2010. The counsel for the company said Mishra had not raised any objections but purposely filed the case to harass the construction firm.
The company, in its reply to Mishra’s petition, stressed that it had stuck to the agreement and renovated the building as promised.
