Kasab to appeal: Lawyer

Mumbai, Feb. 23: Ajmal Kasab has told his lawyer that he wants to move the Supreme Court against the death sentence confirmed by Bombay High Court on Monday.

Farhana Shah, the state-appointed lawyer for Kasab, met the 26/11 terrorist in his special security cell at the Arthur Road prison this afternoon.

“I informed him of Monday’s order and told him that as per proceedings, he had a legal right to appeal against the order in the apex court,” Shah said.

Her meeting with Kasab lasted five minutes. “Theek hai, appeal karenge,” Shah quoted Kasab as saying.

After the lower court sentenced him to death in May last year for his role in the attacks in Mumbai, Kasab had approached the high court.

The Maharashtra State Legal Aid Authority had appointed two lawyers, Amin Solkar and Farhana Shah, to represent Kasab for the hearing that commenced in October.

As the two were appointed to represent Kasab only in Bombay High Court, Kasab will have to appeal in the apex court through the jail. He will have to write a letter to the Arthur Road jail superintendent, stating that he wants to appeal against the high court’s order.

“He will receive a certified copy of the judgment from the court’s registrar and can then appeal within 90 days from date the order was passed,” Shah said.

Legal aid for the appeal in the Supreme Court will be provided from Delhi, she said.

The Bombay High Court order, which states that there is “hardly any scope for a person like Kasab to be rehabilitated or reformed”, held Kasab guilty of waging war against the Government of India and the murder of 66 persons.
